A British father has been spared prison after a Cypriot court ordered him to pay a fine following the fatal fall of his three-year-old son from a hotel window in Paphos. Joshua Foster, 37, pleaded guilty to causing the death of his child through a reckless, rash, or dangerous act on Friday. The court imposed a fine of 3,000 euros ($3,370) instead of a custodial sentence, which could have carried a maximum term of four years.

The tragic incident occurred in July during the family's first day of vacation in the holiday town of Paphos. According to the court, Foster and other family members had spent time around the hotel pool before returning to their rooms to prepare for dinner. Foster then left the room with his son and the child's grandfather. While waiting for the lift, he placed the child on a windowsill so the boy could see a nearby water park, unaware that the window was open.

The child fell approximately 10 metres (33 feet) from the fourth floor. Despite efforts to resuscitate him, the boy was pronounced dead at the local hospital. The Paphos District Court described the incident as a "momentary error" rather than a deliberate act, noting the significant personal loss suffered by the father.

During the sentencing, Foster's parents and other relatives were present in the courtroom. Cypriot state media reported that some family members were seen weeping and embracing Foster after the decision was announced. Foster's lawyer, Alexandros Alexandrou, had urged the court to consider his client's guilty plea, clean criminal record, and the immeasurable personal loss he had endured.

"The court accepted this was a momentary mistake, not conscious negligence," Alexandrou told reporters after the decision. "This was an unfortunate incident. Any sentence cannot bring justice." He further argued that the case should never have gone to court.

Foster, who is from Essex near London according to the BBC, was allowed to return to the United Kingdom during the legal proceedings to attend his son's funeral. The case highlights the severe consequences of accidental tragedies in holiday settings, with the court ultimately prioritizing the nature of the error over punitive imprisonment.
