The African Action Congress (AAC) has filed a suit in the Federal High Court in Abuja, seeking a declaration that President Bola Tinubu violated Section 145(1) of the 1999 Constitution, as amended, by travelling to Europe on a month‑long vacation without first transmitting a written notice to the National Assembly (NASS). The filing, marked FHC/ABJ/CS/2358/2026, was lodged on Monday and names the President, the Attorney General of the Federation, the Senate President, the Speaker of the House of Representatives and NASS itself as defendants.
According to the plaintiff’s complaint, President Tinubu departed Nigeria for Europe on 30 August 2026 and remained abroad at the time the legal action was instituted. The AAC argues that the Constitution expressly requires the President to submit a written declaration to both the Senate President and the Speaker of the House before undertaking any vacation, regardless of its length.
The party also contends that NASS failed to convene and pass a resolution authorising the Vice‑President to act as President after Tinubu had been away for more than 21 days, a breach the AAC describes as “unlawful, unconstitutional and a violation of the mandatory duty imposed on the National Assembly under Section 145(2).”
Among the reliefs sought, the AAC requests that the court declare the President’s alleged failure to give notice “undemocratic and a gross violation of the Constitution” and that the National Assembly’s inaction be similarly declared unlawful. The suit also asks for a perpetual injunction preventing President Tinubu from embarking on any future vacation—whether within or outside Nigeria—without first providing the required written declaration to the Senate President and the Speaker.
No hearing date has been set for the case, and the matter remains pending before the Federal High Court.
