The U.S. Department of Education announced on Monday that it has formally rescinded the Biden-era interpretation of Title IX, which previously provided sex-based discrimination protections to students based on sexual orientation and gender identity. The move reverses regulations established during the previous administration, returning schools to the Title IX code framework in place under the Trump administration in 2020.
Education Secretary Linda McMahon stated that the new regulations align with court orders and Congressional intent, aiming to reduce confusion for parents, students, and educational institutions. “We will continue to relentlessly champion equal opportunity for all Americans and hold accountable any school or college that violates the rights, privacy, or athletic opportunities of our women and girls,” McMahon said. The department indicated that the 2020 framework is designed to protect women’s sports programs.
The Biden-era rule had already been struck down by the court system following legal challenges from Republican states. Since President Trump returned to office, the administration has pursued its own definition of Title IX compliance, including negotiating agreements with institutions such as the University of Pennsylvania to remove transgender athletes from women’s competitive programs.
Critics of the rescission argue that the policy change will negatively impact transgender athletes and weaken existing protections for victims of sexual assault. Shiwali Patel, senior director of education justice at the National Women’s Law Center, criticized the decision, stating that sexual harassment and assault remain pervasive in schools.
“Yet, Education Secretary Linda McMahon and the Trump administration have decided to ignore what survivors need, instead weaponizing Title IX to attack trans students,” Patel said.
The department maintains that the updated regulations faithfully reflect legal mandates, while opponents contend that the shift prioritizes athletic policy over the safety and legal protections of student survivors of sexual violence.
