The Department of Justice added a new request to the case on Friday, asking the judge to separate all ballots that show votes for the second Dan Sullivan until it can be determined whether voters were misled into casting their votes for a spoiler candidate.

The move comes after a Trump‑aligned demand to set aside Senate ballots in Alaska was dismissed by attorneys representing the state as “meritless” and “not even possible.”

Under the DOJ’s request, the judge will review the ballots in question to assess whether voters were confused by the presence of a second candidate with the same name, which could have caused them to waste their votes.

Once the review is complete, the court will decide whether to exclude those ballots from the final count or to allow them to remain in the tally.

Alaska’s election officials and the federal court will monitor the proceedings closely as the case moves forward.
